1. This Privacy Policy (hereinafter referred to as “Policy” or “Privacy Policy”) sets out how Mythik Entertainment Technologies Private Limited (“Mythik”/“our”/“us”) uses and protects any personal information of the users (‘Users”/ “you” / “your”) that we collect from or through the (a) website Mythik (‘Website’) and/or (c) any applications developed by Mythik to provide you with the services; and/or (c) use of the Website or application, products and services offered by us;  including all information, content, features, tools, products and services provided therein, in order to provide you, the customer, with a curated shopping experience (the "Services"). Mythik is powered by Shopify, which enables us to provide the Services to you.

This Privacy Policy is meant to help the Users understand what information we collect, why we collect it, how we collect and process such information, what information we disclose and how the users can update, manage, export, and delete their information . This Privacy Policy shall be read with the terms and conditions / terms of service available on Terms of Services (‘Terms of Service’) and in compliance with the following (a) Digital Personal Data Protection Act, 2023; (b) The Information Technology Act, 2000 and rules thereunder; (c)  The Information Technology (Reasonable Security Practices and Procedures and Personal Information) Rules, 2011 (the IT Rules); and (d) The Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021. If there is a conflict between our Terms of Service and this Privacy Policy, this Privacy Policy controls with respect to the collection, processing, and disclosure of your Personal Information.

By using the Website or availing any Services or by otherwise giving us your information, you will be deemed to have read, understood and agreed to the practices and policies outlined in this Privacy Policy and agree to be bound by the Privacy Policy. You hereby consent to our collection, use and sharing, disclosure of your information as described in this Privacy Policy. We reserve the right to change, modify, add or delete portions of the terms of this Privacy Policy, at our sole discretion, at any time. If you do not agree with this Privacy Policy at any time, do not use the Website or any Services or give us any of your information. If you use the Website or Services on behalf of someone else such as an entity (your employer), you represent that you are authorised by such individual or entity to (i) accept this Privacy Policy on such individual's or entity's behalf, and (ii) consent on behalf of such individual or entity to our collection, use and disclosure of such individual's or entity's information as described in this Privacy Policy.

4.1. We collect, process and store your personal information when you use our Website and/or our Services. We use this information to provide you with a safe, efficient, smooth, and customised experience, which includes, without limitation, displaying content such as recommended products that might interest you and communicating with you about your orders, new products, and latest promotional offers. This allows us to provide specific Services and features that most likely meet your needs, customise our Website to make your experience safer and easier, and enable third parties to carry out technical, logistical, and other functions on our behalf.

Depending on how you interact with us or which of the Services you use, we may use personal information for the following purposes:

  • Provide, Tailor, and Improve the Services. We use your personal information to provide you with the Services, including to perform our contract with you, to process your payments, to fulfill your orders, to remember your preferences and items you are interested in, to send notifications to you related to your account, to process purchases, returns, exchanges or other transactions, to create, maintain and otherwise manage your account, to arrange for shipping, to facilitate any returns and exchanges, to enable you to post reviews, and to create a customized shopping experience for you, such as recommending products related to your purchases. This may include using your personal information to better tailor and improve the Services.

We use your personal information for marketing and promotional purposes, such as to send marketing, advertising and promotional communications by email, text message or postal mail, and to show you online advertisements for products or services on the Services or other websites, including based on items you previously have purchased or added to your cart and other activity on the Services.

We use your personal information to authenticate your account, to provide a secure payment and shopping experience, detect, investigate or take action regarding possible fraudulent, illegal, unsafe, or malicious activity, protect public safety, and to secure our services. If you choose to use the Services and register an account, you are responsible for keeping your account credentials safe. We highly recommend that you do not share your username, password or other access details with anyone else.

6. How We Disclose Personal Information

In certain circumstances, we may disclose your personal information to third parties for legitimate purposes in accordance with the applicable law as per the terms of this Privacy Policy. Such circumstances may include:

  • With Shopify, vendors and other third parties who we may engage to help facilitate delivery of the Services on our behalf so as to enable Mythik to render its Services to the Users (e.g. IT management, payment processing, data analytics, customer support, cloud storage, fulfilment and shipping).
  • With business and marketing partners to provide marketing services and advertise to you. For example, we use Shopify to support personalized advertising with third-party services based on your online activity with different merchants and websites. Our business and marketing partners will use your information in accordance with their own privacy notices. Depending on where you reside, you may have a right to direct us not to share information about you to show you targeted advertisements and marketing based on your online activity with different merchants and websites.
  • When you direct, request us or otherwise consent to our disclosure of certain information to third parties, such as to ship you products or through your use of social media widgets or login integrations.
  • With our affiliates or otherwise within our corporate group to carry out our daily business operations and so we can maintain, improve and provide the Services and acquired companies’ services to you.
  • In connection with a business transaction such as a merger or bankruptcy/insolvency, to comply with any applicable legal obligations (including to respond to subpoenas, search warrants and similar requests), to enforce any applicable terms of service or policies, and to protect or defend the Services, our rights, and the rights of our users or others.

7. Relationship with Shopify

The Services are hosted by Shopify, which independently collects and processes personal information about your access to and use of the Services in order to provide and improve their services to you. Information you submit to the Services will be transmitted to and shared with Shopify as well as third parties that may be located in countries other than where you reside, in order to provide and improve the Services for you. In addition, to help protect, grow, and improve our business, we use certain Shopify enhanced features that incorporate data and information obtained from your interactions with our Website, along with other merchants and with Shopify. To provide these enhanced features, Shopify may make use of personal information collected about your interactions with our store, along with other merchants, and with Shopify. In these circumstances, Shopify is responsible for the processing of your personal information, including for responding to your requests to exercise your rights over use of your personal information for these purposes. 8. Third Party Websites and Links

The Services may provide links to websites or other online platforms operated by third parties. If you follow links to sites not affiliated or controlled by us, you should review their privacy and security policies and other terms and conditions. We do not guarantee and are not responsible for the privacy or security of such sites, including the accuracy, completeness, or reliability of information found on these sites. Information you provide on public or semi-public venues, including information you share on third-party social networking platforms may also be viewable by other users of the Services and/or users of those third-party platforms without limitation as to its use by us or by a third party. Our inclusion of such links does not, by itself, imply any endorsement of the content on such platforms or of their owners or operators, except as disclosed on the Services.

9. Children's Data

Mythik respects the privacy of children. Our Services including the Website is not intended or directed towards children under the age of 18. Please do not use our Services if you are under the age of 18.  We do not knowingly collect or solicit personal data from children under the age of 18. We are committed to complying with the applicable laws and regulations pertaining to protection of children.  In the event, it has been brought to our knowledge that we have inadvertently collected personal data from a child, we will delete that information as soon as possible. If you believe that we might have any information from or about a child, please contact us as described in the “Contact Us” section below.

As of the Effective Date of this Privacy Policy, we do not have actual knowledge that we "share" or "sell" (as those terms are defined in applicable law) personal information of individuals under 18 years of age.

10. Data Security 

  • We care about the security of your personal information, and use appropriate physical, technical, and administrative security measures to preserve the integrity and security of your personal data collected by us through the Services. Where personal data is not anonymised, we use industry standard SSL (secure socket layer technology) and TLS (transport layer security) encryption for personal data in transit. Other security safeguards that Shopify provisions for include, but are not limited to, anonymisation, pseudonymisation, data encryption, firewall, and physical access controls to buildings and files. We also get periodic audits conducted of our security to apply best practices and reasonable industry standards.  
  • Some of the precautions we take to protect personal data includes: (a) limiting employee/consultant access to personal data to only those employees/consultants with a need to such access to fulfil their job responsibilities; (b) requiring employees/consultants to sign confidentiality agreements upon hiring; (c) conducting regular employee/consultant privacy and data security training and education; and (d) protecting personal data with commercially reasonable technical, contractual, administrative, and physical security safeguards. 
  • At registration, we assign a User ID to each account on our Services and use those User IDs to authenticate logins, allow access to the Website. The User ID is also used to authenticate Users when requesting customer and technical support. Access to information is limited to those employees/consultants who require it to perform their job functions.
  • Although we endeavour to deploy state of the art security measures, tools and practices, we cannot ensure or warrant that any of your information will not be subject to any unlawful disclosure as no data transmission over the internet can be guaranteed to be completely secure. Moreover, we are not responsible for the security of information you transmit to the Services over networks that we do not control, including the internet and wireless networks.   • In the event that any information under our control is compromised as a result of a breach of security, we will take reasonable steps to investigate the situation and notify you and the relevant data authorities that information has been compromised if and as required under the applicable laws or deemed necessary and appropriate under the circumstances. We will also take reasonable steps, in accordance with the applicable laws and regulations

  • We aim to take reasonable steps to allow you to correct, amend, delete, or limit the use of your personal information. You can edit certain information with respect to your profile on our Service at any time in accordance with the mechanism provided under the Terms.  
  • In certain circumstances, you have the following data protection rights which can be exercised by you by contacting us at the contact information provided in the “Contact Us” section below -  
    • Access: You have the right to request a copy of the personal information that we process about you. However, there are exceptions to this right, so that access may be denied if, for example, making the information available to you would adversely affect the rights and freedoms of another person or User, or if we are legally prevented from disclosing such information, or if we only store such information about you in an anonymised or aggregated manner where we cannot identify the particular User to whom the data belongs to.  
    • Accuracy: We aim to keep your personal information accurate and complete. We encourage you to keep us informed about changes that you would like reflected in our records. You are also able to update, correct or rectify certain inaccurate personal data in accordance with the mechanism provided in the Terms of Service. 
    • Correction: You have the right to request the rectification of inaccurate personal information and, taking into account the purposes of the processing, to complete your personal information. You are also able to update, correct or rectify certain inaccurate personal information in accordance with the mechanism provided in the Terms. 
    • Erasure: You have the right to delete or request that we delete your personal information as far as legal requirements for deletion are fulfilled, such as when your personal information is no longer necessary for the purposes for which it was collected or where we have relied only on your consent to process your personal information. 
    • The Right to Withdraw Consent: Where you provided us with your consent and where we relied on your consent to collect and process your personal information, you may withdraw your consent to the collection and processing of personal information at any time by sending a written request to the contact details provided under the ‘Contact Us at’ section in this Policy. Withdrawing consent may impact your use of whole or part of the Services, such as access to certain Services. We may still be able to process the personal information for which you have withdrawn your consent for certain legitimate uses for collection and processing of such information or if required under the applicable laws. 
    • Right to Nominate: You shall have the right to nominate in such manner as may be prescribed by the applicable laws, any other individual who shall in the event of your death or incapacity exercise your rights in relation to your personal information under applicable laws. In this regard ‘incapacity’ shall have the meaning ascribed to it under the Digital Personal Data Protection Act, 2023.
  • We will handle your request for exercising your data protection rights in accordance with the applicable laws. If we cannot provide you with access to your personal information, we will inform you of the reasons why, subject to any legal or regulatory restrictions. Please note that we may ask you to verify your identity before responding to such requests. Some of these rights only apply in certain circumstances and in many cases, are limited by law. For example, where fulfilling your request will adversely affect other individuals or our trade secrets or intellectual property, where there are overriding public interest reasons or where we are required by law to retain your personal data. We will respond to your requests to exercise these rights as required by applicable law. 
  • You also have the right to complain to the relevant data protection authority about our collection and use of your personal information. However, we invite you to contact us with any concern, as we would be happy to try to resolve it directly. 12. International Transfers

Please note that we may transfer, store and process your personal information outside India, provided that the processing of such personal information in such country is not restricted by the Central Government as per the provisions of the Digital Personal Data Protection Act, 2023.

If we transfer your personal information out of the European Economic Area or the United Kingdom, we will rely on recognized transfer mechanisms like the European Commission's Standard Contractual Clauses, or any equivalent contracts issued by the relevant competent authority of the UK, as relevant, unless the data transfer is to a country that has been determined to provide an adequate level of protection.

  • We may periodically update this Privacy Policy to reflect the existing practice and to ensure compliance with the applicable laws. We may change or otherwise modify this Privacy Policy to reflect changes to our Services or changes to the applicable laws. If we modify this Privacy Policy, we will update the “Last Updated” date which can be found at the top of this Privacy Policy. 
  • If we make any material changes to the way we collect, use, store and/or share your personal information, we will notify you by prominently posting a notice of the changes on the Services/Website or through push notifications on the Services/Website. We highly recommend that you check this page from time to time to inform yourself of any changes.  
  • By continuing to use the Service/Website after receiving such updates, you agree to comply with, and to be bound by such updated Privacy Policy.
